ISLAMABAD: The Islamabad High Court (IHC) has scheduled a hearing for Thursday on a petition filed by Pakistan Tehreek-e-Insaf (PTI) founder and former Prime Minister Imran Khan, seeking to prevent his transfer to military custody. Despite objections, the court’s Registrar’s Office set the petition for hearing, with Justice Miangul Hassan Aurangzeb presiding over the case.
Imran Khan filed the petition over fears that he may be subjected to a military trial in connection with the May 9 cases. His legal team argued that the Pakistan Army had already detained a retired officer, Lieutenant General (retd) Faiz Hameed, who could testify against him, raising concerns that Khan might be tried under military law. The petition calls on the IHC to ensure that Khan remains under the jurisdiction of civilian courts and is not transferred to military custody. It names the federal government, the interior and defence ministries, the Islamabad and Punjab police, and the Adiala Jail authorities as respondents.

Khan’s legal concerns also involve Lt-Gen (retd) Faiz Hameed, the former chief of the Inter-Services Intelligence (ISI), who has been accused of multiple charges, including misuse of authority and political collusion. With Hameed’s recent arrest, Khan fears that he could be implicated in these allegations, given the former general’s role and close association with the PTI. The Pakistan Army has reiterated that it has no political agenda. General Sharif emphasized that the military operates within the confines of the Constitution and works alongside the civilian government. The outcome of the IHC hearing will be closely monitored as it could set a precedent for how the legal and military systems intersect in cases involving prominent political figures.
