ISLAMABAD: The Supreme Court of Pakistan has clarified in a detailed written judgment that no divorce, including triple talaq, takes effect until a mandatory 90-day period is completed.
A three-judge bench headed by Chief Justice Yahya Afridi said that under Section 7 of the Muslim Family Laws Ordinance, this 90-day waiting period is essential. The court added that if a husband grants his wife unconditional right of divorce, she retains full authority to revoke it within this period.
The Supreme Court upheld the Sindh High Court’s October 7, 2024 ruling. In the case, wife Muriel Shah issued a divorce notice on July 3, 2023, but withdrew it on August 10 before the 90 days had passed, leading the Union Council to terminate proceedings. The judgment emphasized that the wife’s right of divorce is complete and unconditional.
