SC urges restraint on constitutional bench cases

ISLAMABAD: The Supreme Court of Pakistan has resolved the case concerning excessive billing by Sui Northern Gas Pipelines, with Justice Mansoor Ali Shah advising that not all cases should be taken to constitutional benches.

During the hearing of the excessive billing case, a two-member bench comprising Justice Mansoor Ali Shah and Justice Aqeel Abbasi addressed the matter, following comments from the applicant’s lawyer about pending reviews after the 26th Constitutional Amendment. The justice pointed out that while the legal framework has expanded, it is essential to maintain a balance in how cases are processed through the judiciary.

With a smile, Justice Shah remarked, “Please do not take all cases to constitutional benches; leave some for us.” He clarified that there were no constitutional or legal questions at stake in this case, allowing the pending review applicant to raise questions as appropriate. This statement reflects the court’s intent to ensure efficiency and clarity in judicial proceedings, emphasizing the importance of reserving constitutional benches for cases that genuinely require their expertise.

The Supreme Court reiterated its position that while the judicial system must adapt to new legal challenges, it must also safeguard its resources and maintain a clear procedural framework for addressing various legal issues.
