KARACHI: The Sindh High Court has expressed concern over delays in the trial of the Mustafa Amir murder case and ordered the trial court to submit the case record and a report on its progress.
The order came after Mustafa Amir’s mother approached the high court, complaining about delays in the proceedings and seeking an explanation for the prolonged adjournments.
During the hearing, the court asked whether Section 302 of the Pakistan Penal Code had been added to the case. The petitioner’s lawyer said the accused, Armaghan, was facing several cases and had allegedly been using different tactics to delay proceedings.
The lawyer told the court that proceedings had been delayed on various grounds, including disputes between the accused and his parents, the absence of his lawyer and claims that the accused did not have confidence in the trial court.
The court questioned why the cases were not progressing, observing that if the accused was responsible for delaying the proceedings, the prosecution should ensure that the trial moved forward without unnecessary delays.
The petitioner’s lawyer said the case was extremely important but that the proceedings had so far largely involved repeated dates. The court observed that if the accused was using delaying tactics, the prosecution should take steps to ensure an early trial. It said directions would be issued to the trial court and prosecution on how the proceedings should be conducted.
Justice Abdul Rahman also asked whether a medical board had been constituted for the accused’s psychological examination following his request. The petitioner’s lawyer said no medical board had yet been formed. Justice Iqbal Kalhoro asked whether charges had been formally framed in the case and directed the petitioner’s side to seek an early trial.
The court warned that a delay of two years could affect witness testimony, as witnesses might forget important details over time. The petitioner’s lawyer told the court that an application had already been submitted and that the relevant record was available in the case diary.
The high court directed that a report on the progress of the case and the adjournments that had occurred be presented at the next hearing.

Speaking outside the Sindh High Court after the hearing, Mustafa Amir’s mother said the case had been delayed for about a year and a half and that unnecessary delays were taking place.
She said she had approached the high court to seek an explanation for the delay and to ensure that the reasons behind the prolonged proceedings were examined.
