PESHAWAR: A legal petition has been filed in Islamabad seeking the reinstatement of Ali Amin Gandapur as Chief Minister of Khyber Pakhtunkhwa, marking another escalation in the political and constitutional dispute over the province’s leadership.
The application has been submitted to the newly established Federal Constitutional Court in Islamabad by Member of National Assembly Sher Afzal Marwat, a senior figure in the Pakistan Tehreek-e-Insaf.
In his petition, Marwat has argued that the resignation of Ali Amin Gandapur was unconstitutional and should be declared null and void. He contends that the de-notification of Gandapur as chief minister was illegal and contrary to the Constitution, alleging that the process was driven by external pressure rather than due legal procedure.
The petition further claims that the resignation was obtained under coercion and therefore carries no legal standing. It describes the change in leadership as being influenced by what it calls the diktat of an “ineligible individual,” without naming the person directly.

He has asked the court to reinstate Gandapur as chief minister and to invalidate all administrative decisions taken following what he describes as unconstitutional actions, arguing that any subsequent government orders lack legal authority if the original removal is found to be unlawful.
The case adds a fresh legal dimension to the ongoing political contest over Khyber Pakhtunkhwa’s top office, where questions of internal party authority, constitutional procedure and administrative legitimacy continue to overlap.
